DIFFERENT TYPES OF CLAIM

Here are some examples of the types of accident and injury claims that may give rise to compensation. It is your right to claim compensation if you have been injured or disadvantaged through no fault of your own.

Road Traffic Accidents

These cover drivers, riders, passengers and pedestrians; all can be injured as a result of bad driving. If you did not cause the accident you can claim: even if the bad driver was uninsured or cannot be traced. You can claim for the injury, the vehicle damage, hire costs of alternate vehicles, loss of wages etc.
After an accident make sure if you are injured the police are called

Get the name and address of the driver who caused the accident and the make of vehicle he was driving and the registration number

If possible get details of his insurer-don’t worry too much about this as long as you have his name and address we can get these details for you.

Injury at Work

If you had an accident at work and you are not entirely to blame for it, you have a good claim. Parliament and the courts have imposed a high duty of care on your employer to keep you safe at work. Your employer must make sure your work tools and equipment are safe to use. They must make sure your fellow employees do not by mistake, injure you. They must make sure the job you are asked to do is safe to do. If your employer fails to carry out his duties and you are injured as a result, he must pay you compensation.

If you are injured at work you will probably lose some or all of your wages; we can back the loss for you.

Criminal Injury

If you are assaulted and hurt you may be entitled to compensation. The awards can be substantial
these are not accident claims. They are claims made against a government authority. The government set up a scheme some years ago to give compensation to people who it considers suffered personal injury as a result of crime.

Public liability

If you fall over because of a defect in a pavement or slip in your local supermarket and suffer personal injury, you may well have a claim for compensation.
You need specialist legal advice to stop the local council’s or shops insurance company wrongfully refusing to pay you compensation.

If you fall on the pavement, on the footpath or road it is vital that somebody takes high definition photographs with measurements shown on the photographs. These photographs have to be taken before the council has a chance to destroy the evidence by repairing the pavement.
